On behalf of the Real Estate Council of Ontario I acknowledge receipt of your completed complaint form.
We have reviewed your complaints and while we understand and appreciate your concerns, the information reviewed thus far does not appear to indicate non-compliance with the Real Estate and Business Broker’s Act, 2002, (REBBA 2002). If a registrant were to contact an expired listing where the seller has indicated that he/she does not wish to be contacted after expiry, this could be viewed as unprofessional behavior by the registrant contrary to REBBA 2002. In addition, this could potentially be a contravention of the federal privacy legislation. You may contact the Office of the Privacy Commissioner of Canada (www.priv.gc.ca) for more information in that regard. In addition, be aware that information such as the completion date and purchase price of a real estate transaction become public information after closing, available through land registry offices in Ontario. As there is no apparent contravention of REBBA 2002 in the situation outlined, we are unable to proceed further with your complaint.
